Terms of the online shop and electronic services at trzebachleba.pl
§ 1. General provisions
1. These Terms set out the rules for using the website trzebachleba.pl (the Service), including services provided electronically and placing and fulfilling orders for bakery products with in-store pickup. 2. The Service is operated by Trzeba chleba Bartłomiej Krawczyk (trading name: Trzeba Chleba), address: ul. Wojewódzka 36/38, 40-026 Katowice, NIP (tax ID): 6343048179, REGON: 540185091, wpis do Centralnej Ewidencji i Informacji o Działalności Gospodarczej (CEIDG) (the Bakery). 3. Shop and pickup point: ul. Wojewódzka 36/38, 40-026 Katowice. 4. Contact: e-mail kontakt@trzebachleba.pl, phone +48 572 359 415 (standard operator rates), or in person at the shop. 5. The Terms are available free of charge in a form that allows downloading, saving and printing. Reading and accepting the Terms is required to place an order or create an Account. 6. The Polish version of these Terms prevails.
§ 2. Definitions
Customer - a natural person, legal person or organisational unit using the Service, including a Consumer. Consumer - a natural person concluding a transaction with the Bakery not directly related to their business or profession. Consumer provisions also apply to a sole trader whose contract is not of a professional nature for them (Art. 385⁵ of the Polish Civil Code). Account - a free electronic service identified by an e-mail address and password, storing the Customer's data and order history. Order - the Customer's declaration of intent submitted via the Service aimed at concluding a sales contract with in-store pickup. Business day - a day on which the shop is open according to the opening hours published in the Service.
§ 3. Electronic services and technical requirements
1. The Bakery provides the following free services: browsing the offer, cart and order form, Account, contact form and newsletter. 2. Requirements: a device with internet access, an up-to-date browser with JavaScript, cookies and local storage enabled and, for the Account, newsletter and order confirmations, an active e-mail address. 3. The contract for using the order or contact form is concluded when you start filling it in and ends when it is sent or abandoned. Contracts for the Account and the newsletter are concluded for an indefinite period. 4. Customers must not provide unlawful content or disrupt the Service. 5. Specific risks of using electronic services include malware, phishing and theft of login data. Keep your software up to date and do not share your password.
§ 4. Placing orders and concluding the contract
1. Orders can be placed 24/7. An order for a given business day can be placed until the shop opens on that day; after that, for following days. 2. A phone number is required to identify the Order at pickup and to contact you about it. An Account is not required. 3. Before placing the Order you see a summary: products, quantities, total price, pickup date and approximate pickup time. The Order is placed with the “Order with obligation to pay” button. 4. The sales contract is concluded when the Service displays the order confirmation. We send a confirmation with the contract details to the Account e-mail or to the e-mail address entered in the order form. 5. Product availability is updated in real time; unavailable products cannot be ordered.
§ 5. Prices, product information and payment
1. Prices are gross prices in Polish zloty including VAT. For products with a declared weight we also show the price per kilogram. 2. The binding price is the price shown when the Order is placed. Price changes do not affect Orders already placed. 3. Payment is made at pickup in the shop - in cash or by card. The Service does not take online payments. 4. Information on ingredients and allergens is available in the shop, by phone or by e-mail before placing an Order. 5. Discount codes apply on the terms announced with them; the discount is shown in the order summary.
§ 6. Pickup
1. Orders are fulfilled only as in-store pickup. The Bakery does not deliver. 2. Orders can be collected during opening hours on the date stated in the Order. The selected time slot is approximate and helps us prepare the Order. 3. Please give the phone number used in the Order at pickup.
§ 7. Cancellation by the Customer
1. You can cancel an Order free of charge no later than 4 hours before the shop closes on the pickup day - in your Account, by phone or by e-mail. 2. After that, cancellation via the Service is not possible because the products are already being prepared. If necessary, please call us. 3. The pickup date cannot be changed - cancel the Order and place a new one instead.
§ 8. Cancellation by the Bakery
1. The Bakery may cancel an Order in whole or in part only for important reasons: lack of ingredients, equipment failure, an unsuccessful bake or another event preventing preparation of a product of proper quality. 2. We inform you promptly by phone or e-mail. You bear no costs for cancelled products - payment is made at pickup, so we do not charge for them. 3. This does not limit the Consumer's statutory rights.
§ 9. Uncollected orders
1. Uncollected Orders are recorded, as prepared bread often cannot be resold. 2. If a Customer fails to collect or cancel an Order at least 3 times within 6 months, the Bakery may block online ordering for the phone number used in those Orders. 3. The decision is taken by a member of staff after reviewing the order history - it is not automated. We inform the Customer, who may contest the block by contacting us. The block does not apply to purchases in the shop. 4. The Bakery may call the Customer if pickup is delayed.
§ 10. No right of withdrawal
1. Contracts concluded via the Service are distance contracts. 2. Consumers have no right to withdraw from contracts for bread and pastries, as these goods deteriorate rapidly or have a short shelf life (Art. 38(1)(4) of the Polish Consumer Rights Act). This also applies to products made to the Customer's specification (Art. 38(1)(3)). 3. Until the deadline in § 7 you may cancel the Order free of charge.
§ 11. Complaints
1. The Bakery is liable to Consumers for the conformity of products with the contract under the Consumer Rights Act (Arts. 43a-43g) for 2 years from handover - bearing in mind the short shelf life of bread. 2. Complaints can be made in the shop, by e-mail to kontakt@trzebachleba.pl or in writing to the shop address. Please describe the problem, give the order number or phone number and, if possible, a photo. 3. Please report problems as soon as possible, ideally on the pickup day, so we can assess and replace the product quickly. This is a request, not a condition, and does not limit your statutory rights. 4. We respond within 14 days. If the complaint is accepted we replace the product or, if that is not possible, reduce the price or refund the amount paid. 5. Complaints about the Service can be sent by e-mail and are handled within the same time.
§ 12. Out-of-court dispute resolution
1. Consumers may use out-of-court complaint and redress procedures, in particular: • the Provincial Trade Inspectorate (mediation or permanent consumer arbitration court), • the municipal or district consumer ombudsman or a consumer organisation. 2. Information is available at polubowne.uokik.gov.pl. These procedures are voluntary and require the consent of both parties. 3. If a complaint is rejected, our reply will state whether the Bakery agrees to out-of-court resolution.
§ 13. Account
1. Creating an Account is voluntary and free. It lets you view order history, cancel Orders and receive confirmations. 2. You must provide true data and keep your login details safe. 3. You can delete your Account at any time in your profile settings or by e-mail. Deleting the Account does not cancel Orders already placed; data needed for accounting is kept as described in the Privacy Policy. 4. The Bakery may block or delete an Account for a serious breach of the Terms (e.g. unlawful content or attempts to disrupt the Service), after a prior request to stop, unless such a request would be pointless. We inform the Customer of the reason by e-mail.
§ 14. Newsletter
1. The newsletter is free and voluntary. Signing up requires an e-mail address, consent to receive commercial information and confirmation via a link sent to that address. 2. The newsletter contains news, offers and promotions and is sent in Polish. 3. You can unsubscribe at any time - via the “Unsubscribe” link in each message, in your Account settings or by e-mail.
§ 15. Personal data and cookies
1. The Bakery is the controller of personal data. Data processing and the use of cookies and similar technologies are described in the Privacy Policy.
§ 16. Changes to the Terms
1. The Bakery may amend the Terms only for important reasons: changes in law, changes to how orders, payment or pickup work, new or changed Service features, changes to the Bakery's details, or Service security. 2. We announce changes in the Service and, for Account holders, by e-mail at least 14 days before they take effect. If you do not accept the changes you may delete your Account during that time. 3. Orders placed before a change are governed by the Terms in force when they were placed.
§ 17. Final provisions
1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on Providing Services by Electronic Means. 2. These Terms do not exclude or limit Consumer rights under mandatory law. The competent court is determined under the Code of Civil Procedure. 3. Cooperation with food-service businesses (gastronomy panel) is based on separate arrangements; these Terms apply to it as a supplement. 4. These Terms apply from 01.10.2026.
